UPDT Pty Ltd (ACN 660 129 804) trading as Update (“we”, “us” or “our”) is committed to respecting and safeguarding your right to privacy. Update provides a software application (“App”) to assist users in discovering, planning, and booking activities.

Background

We are committed to protecting your rights in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”). This Privacy Policy outlines how we collect, use, and handle your personal information in accordance with the Privacy Act.


The Privacy Act regulates the collection, use, disclosure, storage, accessibility, and disposal of personal information throughout its lifecycle. Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not. We will comply with the requirements of the Privacy Act when handling your personal information.

Collection of personal information

In the course of our business, we may collect personal information about you that is necessary to provide our services and perform our obligations. We collect personal information lawfully and fairly, and do not gather it in an unreasonable manner.


By accessing our products and services, you consent to the collection, use, storage, and disclosure of your personal information as described in this Privacy Policy.


Update collects personal information about individuals who:


  • plan and book activities;
  • use our App;
  • visit our website and/or App; and
  • are third parties providing a product or service to Update, including personnel of those third parties.

The specific types of personal information we collect may vary depending on the nature of our interaction with you. However, the types of personal information we collect from you may include, without limitation, the following:


  • your full name and date of birth;
  • your contact details such as your email address and telephone number;
  • content which you generate and upload to the App, including photographs, information about your events, attendees, and venues;
  • any social media accounts you integrate with our App;
  • your interests and dietary preferences;
  • your device ID, device type, geo-location information, computer and connection information;
  • details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • any additional information relating to you that you provide to us directly through our App or indirectly through your use of our App or online presence or through other websites or accounts from which you permit us to collect information;
  • information you provide to us through customer surveys or competitions; and
  • any other personal information that may be required in order to facilitate your dealings with us.

In addition to the information you provide to us directly, we may also collect information through the App. This includes:


  • location data, collected using GPS technology (or other similar technology) to determine the city you are located within to display a location map in connection with the services we provide, and for relevant advertisements. We will not share your current location with other users or partners;
  • your mobile device information, collected automatically. Mobile device information includes the type of mobile device you use, your unique device ID, your device's IP address, your operating system, and the type of mobile Internet browsers you use; and
  • usage data, also collected automatically, including information about how you use the App, the features you access, and the actions you take.

If you do not provide personal information requested of you to Update, we may be unable to provide you with the goods or services you request of us or otherwise work or transact with you.

How Update uses your personal information

Update collects, holds, uses, and discloses personal information for a range of purposes including:


  • to provide you with information, updates, and our services;
  • to inform you of new products, services, and opportunities;
  • to review, develop, and improve our products and services by better understanding your needs and asking you to participate in quality improvement surveys and activities;
  • to manage our relationship with you;
  • to verify your identity and update your personal information;
  • to engage third party service providers;
  • to assist with administration, planning, financial, or management purposes;
  • to market our services, including the running of competitions and promotions;
  • to comply with legal or regulatory obligations; and
  • for other purposes required or authorised by or under law, including purposes for which you have provided your express or implied consent.

Disclosure of your personal information

We may disclose your personal information to:


  • our employees, officers, insurers, professional advisers, agents, suppliers, or subcontractors insofar as is reasonably necessary for the purposes set out in this Policy;
  • third parties only where required for the delivery of our services;
  • any person or entity to whom we must disclose your personal information to in order to comply with a legal requirement including a law, regulation, subpoena, warrant, in the course of a legal proceeding, or in response to a law enforcement agency request; and
  • any person or entity to whom we must disclose your personal information to protect the copyright, trademarks, legal rights, property or safety of Update, its application, website and customers or third parties.

Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia. These may include, but are not limited to Alphabet Inc.


If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.


By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by it. Where we disclose your personal information to third parties, we will request that the third party follow this Privacy Policy regarding handling your personal information.

Management and storage

We use Firebase to store and manage user data for our mobile app. Firebase is a cloud-based platform developed by Google that provides various services for building, managing, and scaling mobile and web applications. All user data stored in Firebase is securely encrypted and stored in accordance with industry standards.


Update is committed to ensuring that your personal information is secure. To prevent unauthorised access or disclosure, we have established suitable physical, electronic, and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.


To the extent required by the Privacy Act, Update will take reasonable steps to:


  • make sure that the personal information that we collect, hold, use and disclose is accurate, complete and up to date; and
  • protect the personal information that we hold from misuse, interference and loss and from unauthorised access, modification or disclosure.

Subject to the requirements of the Privacy Act, Update will take reasonable steps to ensure that personal information that is held which is no longer required, including under any contractual or legal requirement, is destroyed or de-identified in a secure manner.


The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

Your right to access your personal information

Please contact us if you would like to seek access to, have deleted, or request that we correct the personal information we hold about you by email to mendle@updt.app.


Update will generally provide you with access to your personal information if practicable and will take reasonable steps to amend any personal information about you which is inaccurate or out of date. In some circumstances and in accordance with the Privacy Act, Update may not permit you access to your personal information, or may refuse to correct your personal information, in which case we will provide you reasons for this decision.

Opt-out right

You can stop all collection of information by Update by uninstalling the App from your device. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at mendle@updt.app.

Changes to Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. When we make changes to this Privacy Policy, we will post the revised policy on our website and update the effective date at the top of this policy. We encourage you to review our Privacy Policy whenever you access our services to stay informed about our information practices and the choices available to you. Your continued use of our services after the effective date of any changes to this Privacy Policy constitutes your acceptance of the revised policy.
